Law enforcement group sues over collective bargaining law

An association representing law enforcement agencies including University of Wisconsin officers and Capitol police has filed a lawsuit challenging the constitutionality of a state law effectively ending collective bargaining for most public workers.

The lawsuit filed Tuesday by the Wisconsin Law Enforcement Association makes similar arguments as a lawsuit brought by Madison teachers and Milwaukee city workers.

A judge in that case in September overturned major portions of the law as it pertained to school district employees and local government workers.

That ruling didn't apply to state employees, like the law enforcement officers who filed the new lawsuit Tuesday.


If the cops prevail in their suit at the trial level, I assume Van Hollen will appeal this one too.

Forgive me for being dense, but didn't Scott Walker specifically exempt fire fighters and law enforcement? Is he reneging or are we talking about different unions?

Different lobbying groups represented different law enforcement groups, and those groups received different treatment -- that seems to be the short version.

from the article:

The lawsuit points out that the two groups exempted from the law — state troopers and inspectors — are represented for lobbying purposes by the Wisconsin Troopers Association, which endorsed Walker in the 2010 election. All other law enforcement groups represented by WLEA that did not endorse a candidate in the 2010 election were covered by the law.

The lawsuit said the law forced the WLEA to break into two parts, each with different rights.

Attorney Lester Pines has been the main legal force behind overturning Walker's unconstitutional attacks on unions, voting rights and attempts to consolidate power over other areas of state government.

Because the Wisconsin Constitution gives home rule powers to Milwaukee, they too think Act 10 can be overturned concerning bargaining with their public employees.

Milwaukee officials want to join union lawsuit
